ASTRO, the American Society for Radiation Oncology, is seeking an experienced attorney with medical specialty society or healthcare related background to provide legal advice and contract review to ASTRO on a variety of issues, including ASTRO’s practice accreditation program, patient safety efforts, research grants and meetings. This individual will also be responsible for oversight of HIPAA and GDPR compliance activities. In addition, this individual will assist with intellectual property issues and licensing of ASTRO products to third parties, as well as legal issues involved in Society website and on-line communities, among other responsibilities.
NOTE: The position is DC area-based and currently an optional work-from-home position due to the COVID-19 pandemic. At this time, there is also the option to work from our HQ offices in Arlington, VA (Crystal City) on a voluntary basis. After ASTRO’s offices fully re-open (target mid-2021), all staff will be expected to return to the offices on a full-time basis, with the opportunity to telework up to two days/week.
Major responsibilities and duties:
Implement and manage ASTRO’s compliance with HIPAA/HITECH law and regulations.
Oversee compliance with GDPR and other privacy laws.
Manage legal aspects of ASTRO’s practice accreditation program (APEx), including negotiating program and business associate agreements with program participants, working in close coordination with program staff.
Manage legal aspects of ASTRO’s sponsorship of a patient safety organization, working in close coordination with program staff.
Manage legal aspects of ASTRO’s Coding Resource and other ASTRO products.
Monitor and advise on legal issues involved in Society website (including Terms of Use and Privacy Policy in compliance with applicable privacy laws), on-line communities and publications
Conduct contract review and drafting for a wide range of Society activities, including ASTRO Meetings contracts.
Work with 501(c)(3) foundation on legal matters, particularly research grants and fundraising.
Provide other legal assistance to the General Counsel as needed.
Supervise outside counsel as needed.
Successful candidates will have:
Education/Experience
J.D. required. Must be licensed to practice law in Virginia or be eligible for admission as a Virginia Corporate Counsel.
A minimum of 5 years legal experience, preferably in a medical specialty society or other healthcare related environment.
Knowledge, Skills, and Abilities
Strong understanding of HIPAA/HITECH and GDPR compliance rules and regulations.
Expertise in drafting contracts and conducting contract review.
Ability to develop internal protocols and compliance policies.
Knowledge of intellectual property law, including trademark and copyright.
Familiarity with tax-exempt organization law.
General knowledge of health law and health policy, particularly Open Payments, self-referral and antikickback.
Strong interpersonal skills with ability to work collaboratively with all levels of individuals, including ASTRO members and program staff.
Excellent written communication skills.
Ability to handle and manage multiple projects and meet critical deadlines.
Demonstrated proficiency in Project Management.
High level of integrity and general familiarity with conflict of interest issues.
Proficient with Microsoft Office Suite.
Minimum travel required, approximately 10% of the time.
